Abstract

This thesis analyzes the ways of criminal and extra-criminal reaction to the phenomenon of the financing of weapons of mass destruction, the existing regulatory gaps, and the importance of prevention and detection measures that can be adopted in the financial sector as a limited but effective way of dealing with it. To this end, the work begins with a study of the criminological reality (Part One). It continues with the analysis of the applicable international criminal law (Part Two), followed by an examination of the international sanctions and embargoes that can reach where criminal law does not (Part Three). The thesis ends with a proposal for the design of compliance measures specifically aimed at combating this phenomenon, with mention of the distinctive characteristics of the patterns of conduct that serve for the prevention and detection of money laundering or the financing of terrorism (Part Four).
