Abstract
This work aims to analyse some issues that influence both the adult and juvenile criminal justice processess relating to domestic and gender violence, such as: the value of the the victim´s testimony when it is the only incriminating evidence; the right not to testify; and the problems arising from the gender violence regulation when it uses the expression «marital relations or equivalent sentimental relationships» to define its scope of protection
