Abstract

This work focuses on the problem that occurs when a trademark that has expired due to lack of use, but which continues to be known by consumers, is ubsequently registered or used by a third party. First, it is studied the figure of the so-called zombie trademark and its resurrection. Then, the cases in which it can be considered that there has been a registration in bad faith are examined and it is argued the impossibility of applying the prohibition of registration of misleading trademarks. The role of residual goodwill of the zombie trademark is also studied as an element that can determine its link with another trademark of its former owner, as well as its relationship with the protection of well-known unregistered trademarks. Finally, the work concludes with the examination of the possible application of the unfair competition law.
