Abstract

We have come to commemorate the fortieth anniversary of the opening for signing in Montego Bay of the 1982 United Nations Convention on the Law of the Sea. Since then, new problems have arisen that significantly affect sustainability and conservation of the oceans and seas that make these spaces find themselves in a situation of “global emergency”, deserving of an action aimed at stopping and reversing the loss of their biodiversity and the degradation of their ecosystems with the aim of protecting and restoring their damaged health. One of these serious problems is marine pollution by plastics and microplastics that has led the international community to initiate a process leading to the negotiation of an international treaty of universal scope to put an end to this type of pollution, including in the marine environment. The objective of the work is to examine the instruments that we have up to now to deal with the impacts of plastic pollution in the marine environment and the need to strengthen them through the adoption of a new global agreement on plastic pollution.
