Zusammenfassung

The interpretation of the will, as a prerequisite for its correct execution, correct execution, corrresponds to the heirs or, where appropriate, to the executor or "contador-partidor", whether or not this power has been expressly granted to them by the testator, insofar as it is necessary for the performance of their function. This paper analyses the criteria, limits and effectiveness of the interpretation upheld by both parties, as well as the role played by the testator himself in the hermeneutic process, with special reference to the value of the clauses prohibiting the judicial interpretation of his will.
