Abstract

Objectives: analysis of the safeguards provided by Spanish legislation to workers with chronic diseases to prevent their exit from the labour market, pointing out major shortcomings. Metho- dology: a legal analysis will be conducted of the applicable legal framework from a labour law perspective, also investigating the role of case law and collective bargaining. Findings: save from some terms laid down in company-level collective agreements, what emerges is a lack of specific measures aimed at protecting chronically-ill workers from their early exit from the labour market. Limitations and implications: adequate protection is needed for workers with chronic diseases enable them to remain in the labour market. Originality: case law and collective bargaining are investigated, with particular reference to the latest changes introduced by Ley 15/2022.
