Abstract

The art. 183.2 of the Ley reguladora de la jurisdicción social (Labour Courts Act) urges the judge to determine prudentially the amount of compensation for the damage caused by the infringement of a fundamental right. This rule gives it a wide discretion that is exacerbated when the injured are the trade union organizations and the strike committee in the different way of exercising the right to strike. In addition, the application allows the amount of compensation set out in the judgment of the court to be reviewed if it is unreasonable or disproportionate, which obliges the higher court to seek and apply a logical criterion even to justify such a review.
