Abstract

The title of this thesis is "The legal protection of software". It analyzes the state of affairs more than thirty years after the entry into force of Directive 91/250/EEC of the European Parliament on the legal protection of computer programs. Therefore, within the objectives of this thesis is the study of the protection granted by our legal system to computer programs after the transposition of Directive 91/250. The aimis to analyze the protection granted in order to clarify the pros and cons of the same, in order to find out the issues that are perfectly applicable today, despite the fact that thirty years have passed since the publication of the rule that gives rise to the protection. Likewise, the aim has been to present the most conflictive points of the regulation at national level in order to propose an improvement, that is to say, a modernization of the national regulation, always respecting the hierarchy of norms, that materializes the questions resolved by the Court of Justice of the European Union in its different sentences...
