Resumo

School bullying has been highlighted in recent decades as a major and growing problem that directly threatens the health and well-being of children and adolescents. This has led national and international organizations to establish its eradication as a priority objective, as proposed by UNESCO (2019) and the Spanish Organic Law 8/2021, which includes school bullying and cyberbullying as an object of the law and indicates the need for educational administrations to regulate action protocols. Thus, it is needed to develop valid and reliable techniques to facilitate the judicial response in school bullying. In line with the Therapeutic Jurisprudence, these protocols should protect children and adolescents, minimize secondary victimization and promote their well-being during the judicial process. For this reason, we propose the following paper, which describes the procedure for obtaining the statement from victims of bullying during the judicial process, especially in the forensic evaluation. Based on the evidence, it is concluded that the most effective technique for this purpose is the Cognitive Interview (Fisher & Geiselman, 1992), which, applied with a Therapeutic Jurisprudence orientation, promotes the well-being of children and adolescents protects them from being victimized during the process. The paper concludes with the implications for victims and professionals in the judicial process.
