Abstract
The fact, that the distinction between the measures of individual or collective flexibility in an enterprise is set to the number of affecting employers, has raised the problem of fixing what the scope of reference is. The criterion in the Workers’ Statute is set in the workplace, but community jurisprudence relating to collective redundancies attributes it to the company as a whole; so that is now discussed whether such a reference is only for external flexibility measures or also to the internal measures.
