Resumo

The article I submit, analyzes an essential obligation that Law 5/2019 imposes on the lender, in the hiring of real estate loans, which is the duty of pre-contractual information. This duty has increased relevance in order to achieve what we call responsible credit. In the field of material transparency, pre-contractual information constitutes a fundamental basis in the borrower’s desired real comprehension of the economic and legal responsibility which each one of the clauses will cause if the borrower signs the agreement. Indeed, having this information, borrowers will be able to compare the different offers of the market, evaluate all the options and will decide about the loan contracting being fully conscious about the consequences which will assume after concluding the contract.
