Resumo
The European Court of Justice, diverting from the opinion of the Advocate General, has established that it is contrary to Directive on unfair terms a national case-law that temporally limits the restitutory effects derived from finding a clause unfair. All amounts overpaid under such a clause must be reimbursed, and not only those paid after the delivery of the decision in which the finding of unfairness was made
