Abstract
Regulation 562/2006 represents one of the main instruments for the complete realization of the free movement of persons in the European Union. In comparation with the equivalent Schengen instruments, it is remarkable the important advance in the protection of fundamental rights. Nevertheless, the effective respect of those rights will very much depend on the suppression to the limitations established by art. 68 ECT to the jurisdiction of the ECJ.
