Abstract
The prohibition of approaching the victim is an ancillary penalty that must be mandatorily imposed by the judge when a person is sentenced for domestic violence or gender-based violence. As result of these regulatory notes, the cases in which the victim consents to breach of the prohibition have notably increased. The aim of this paper is to analyze the jurisprudence relating to the relevance of the victim's consent with respect to the criminal responsibility of both. We will also make some proposals for improving this situation.
