Abstract

The new Act 39/2015, on the Common Administrative Procedure of Public Administrations, has eliminated the civil and labour claims that were mandatory to submit to sue public authorities before these courts. However, it maintains the mandatory nature of the filing of the administrative appeal against acts not end the administrative way, to access the tutelage of contentious-administrative courts, even in cases of administrative silence, one of the manifestations of the «reduplicative autotutela» recognized to the Public Administration in Spanish legal system. This incongruity of the new act requires to consider the constitutionality of maintaining this obstacle to access to the courts in cases in which administrative acts are immediately executive and, therefore, can produce effects that impair rights while the administrative appeal is pending, leaving no room to seek justice before contentious-administrative courts.
