Lobbying, influencias y corrupción. El art. 12 del Convenio del Consejo de Europa contra la corrupción como modelo tipo para la criminalización del lobbying oculto

Resumo

Many opinions have been expressed with regard to the criminalization of certain forms of lobbying, using the arguments of their structural identity and of legal good with trading in influence and their consequences in the field of transparency in public decision-making. The pages that follow will examine the possibility of applying the trading in influence criminalization model contained in the Criminal Law Convention on Corruption of the Council of Europe, ratified by Spain on 26 January 2010. The results could serve as a starting point for taking into consideration and, in appropriate cases, proposing a reform of article 430 of the Criminal Code that permits its effective application to those lobbying activities that, escaping democratic controls, interfere with the public decision-making procedure.
