Seguridad marítima e interceptación de buques en la represión de actividades ilícitas en el Derecho del mar

Resumen

La expansión de organizaciones criminales de carácter transnacional por los mares y océanos se ha convertido en una de las principales amenazas a la seguridad marítima. En este contexto, es necesario analizar las acciones que pueden llevar a cabo los Estados en los espacios marítimos contra estos grupos. A este respecto, la CNUDM, como marco legal de referencia en materia de seguridad marítima, atribuye competencias de ejecución a los Estados para interceptar, dentro de ciertos límites, buques sospechosos de dedicarse a actividades ilícitas. Pero este marco jurídico adolece de importantes carencias restan eficacia a la acción del Estado en el mar y alientan las actividades de estos grupos delictivos. Estas carencias se ponen en evidencia más claramente cuando los agentes estatales deben adoptar medidas coactivas, incluido el uso de la fuerza en los casos más extremos, ante un barco se resiste al apresamiento, pues la CNUDM no ofrece ninguna orientación al respecto. Ante esta situación, que ha sido paliada parcialmente por otros tratados internacionales, es importante que los Estados regulen de forma precisa el ejercicio de estos poderes de policía en el mar, así como las medidas que pueden adoptar en cada caso, para evitar incurrir en abusos o arbitrariedades.
